Terms of Use
1. Scope
These terms govern your use of the ORBit Analytics website and statistics tool (the “Service”). The provider is Tom Löbel (“ORBit Analytics”, “I”, “me”; see the Imprint). By using the Service you accept these terms.
2. The Service
ORBit Analytics provides interactive market-behaviour statistics computed from historical market data. A free tier (the Nasdaq / NQ dataset with every analysis feature) is available with a free account. Additional markets and certain features require a paid subscription. The Service is provided for educational and informational purposes only and is not investment advice. ORBit Analytics is a software and data-analytics product only: it is not a broker, dealer, fund, money-services business or investment adviser, holds no client funds, executes no trades or orders, and provides no buy/sell signals or personalised recommendations. Your subscription pays for access to the software and the computed statistics — see the Disclaimer.
3. Account & Sign-In
Paid features are tied to your email address. Sign-in is passwordless: you request a one-time “magic link” by email and clicking it signs you in on that browser. You are responsible for keeping access to your email account secure. A login token is stored in your browser; logging out or clearing site data removes it.
4. Subscriptions & Billing
Paid plans are billed monthly through our payment processor, Stripe. Prices are shown on the Pricing page. Early-bird prices are guaranteed not to rise for as long as your subscription remains continuously active. You can manage payment details or cancel at any time through the billing portal; on cancellation, access continues until the end of the paid period and is not renewed.
5. Right of Withdrawal (Consumers)
As a digital service supplied immediately, you may be asked to consent to immediate access and to acknowledge that your statutory 14-day right of withdrawal lapses once performance begins. Where the right of withdrawal applies, you may contact me at contact@tlfx.trading.
6. Acceptable Use
You agree not to share your account, scrape or bulk-download the data, resell or redistribute the statistics, or attempt to circumvent the paid-feature gates. Paid datasets are licensed for your personal use only. Abuse may lead to suspension without refund.
7. Intellectual Property
The ORBit Analytics website, the ORBit System methodology, the software and the compiled statistics are protected by intellectual-property rights and remain the property of the provider. You receive a non-exclusive, non-transferable right to use the Service for your own purposes only.
8. Availability & Changes
The Service is provided “as is” and “as available”. Features, datasets and prices for new subscriptions may change over time. I may update these terms; the current version applies to your continued use of the Service.
9. Reviews & Testimonials
Reviews can be submitted by subscribers after a minimum subscription period. If you submit one, you grant me a non-exclusive, royalty-free, worldwide licence to display it — together with your chosen display name and any screenshot you attach — publicly on the Service (for example on the testimonials page) and in related promotion, with no obligation to publish it. Submit only content that is your own and accurate, free of third parties’ personal data or confidential information. I may shorten, decline or remove any review at my discretion. As a thank-you, approved reviews may receive a one-month subscription credit; because this is an incentive, displayed reviews may come from incentivised contributors. You can request removal of your review at any time at contact@tlfx.trading.
10. Affiliate & Referral Program
You can earn a commission by referring new subscribers through our affiliate and refer-a-friend program, which is operated for us by a third-party provider (Endorsely). Joining requires accepting that provider’s terms. Commissions are paid in cash at the rate and on the schedule shown in your affiliate dashboard, and only for genuine new paid subscriptions that remain active through any applicable refund or charge-back period. We may withhold or reverse commissions for cancelled, refunded, fraudulent or self-referred orders.
You must promote the Service honestly and lawfully. The following are not permitted and may end your participation and forfeit unpaid commissions: running paid advertising of any kind to promote the Service — including paid search, social, display, native and video ads — and bidding on our brand name or trademarks; spam, misleading claims, or presenting the Service as investment advice or a guarantee of profit; self-referrals or referring your own paid account; and any attempt to manipulate referral attribution (for example cookie-stuffing). You are responsible for any taxes on commissions you earn and for disclosing your affiliate relationship where the law requires it. We may change the commission rate or the referred-customer discount, or end the program, at any time, and may remove any participant at our discretion.
11. Governing Law
German law applies, to the extent permitted for consumers. If any provision is invalid, the remainder stays in effect.
